These Membership Terms & Conditions summarize the key terms of membership at AWAY Spa at W Dallas Hotel, located at 2440 Victory Park Lane, Dallas, TX 75219. The Spa is owned by Victory Hotel Dunhill LLC (Owner) and operated by W Hotel Management, Inc. (Operator). This summary is provided for convenience; the full Membership Agreement you sign, including its Rules & Regulations and Waiver & Release, governs your membership and controls in the event of any conflict with this page.

Eligibility & Membership

Membership is available to individuals who are at least 18 years of age, subject to approval and availability. Your membership grants you a non-exclusive, non-transferable right to enjoy the social atmosphere of the Spa and to use its recreational and wellness services, amenities, facilities, and equipment, at the times and subject to the Rules & Regulations determined by the Spa. Membership is issued only to the named member, may not be shared, transferred, or assigned, and does not include personal training, diet planning, exercise instruction, or instructional classes. Each member is issued a Membership Card that must be presented to access the Spa and valet parking.

Membership Tiers

The Spa offers three membership tiers, each available as a single or dual membership. ESCAPE includes a monthly single-use spa treatment credit, a day pool pass for the member plus one guest, and a Marriott Bonvoy points bonus for enrolling within the first 30 days. SCENE adds unlimited pool access for the member plus one guest during posted hours, along with the monthly treatment credit and Bonvoy bonus. STATUS includes everything in SCENE plus fitness center membership. Tier features, inclusions, and pricing are set at the time you join, may differ between single and dual memberships, and are subject to change as described in these terms.

Dues & Billing

Membership dues are billed monthly and accrue on the first day of each month. Dues are automatically charged to the credit or debit card on file, generally within the first several days of the month, and you must keep at least one valid card on file at all times. Single memberships cover one person aged 18 or older; dual memberships cover two people aged 18 or older, who are each jointly and severally responsible for all dues and charges. Additional purchases, such as food and beverage, retail, extra guest passes, and additional treatments, are due at the time of purchase.

Dues are nonrefundable and inclusive of applicable taxes and fees. After the initial term, dues may change with at least 30 days advance notice. Past-due balances accrue a late charge of the lesser of 1.5% per month or the maximum permitted by law, and continued non-payment may result in suspension or termination of your membership and referral of the account for collection.

Term, Renewal & Cancellation

Membership begins on the first day of the first full month after all parties sign the Membership Agreement and the first month's dues are paid, and runs for an initial one-month term. After the initial term, membership renews automatically on a month-to-month basis until it is cancelled or terminated in accordance with the Membership Agreement.

You may cancel by providing written notice to the Spa. Cancellation takes effect on the last day of the calendar month that falls 14 days after the Spa receives your notice; notice given fewer than 14 days before month-end carries into one additional month. Certain circumstances, such as death, major permanent disability, or a move more than 60 miles away, allow earlier cancellation. Dues and charges accrue through the final day of membership and prepaid dues are nonrefundable. The Spa may also terminate any membership on at least seven days' written notice, or immediately for serious violations, as described in the Membership Agreement.

Member Conduct & Spa Rules

Members and their guests must comply with the Spa's Rules & Regulations, which govern the use of the facilities, equipment, and services and may be amended at any time in the Spa's discretion. You are responsible for the conduct of your guests, and are expected to act courteously toward other members, guests, and staff. The Spa may restrict, suspend, or terminate membership privileges for conduct that violates the Rules & Regulations, endangers or disturbs others, or is otherwise not in the best interest of the Spa, its members, or the Hotel. Access to the spa lounges, sauna, steam room, fitness center, pool, and social spaces is subject to posted hours, which may change without notice.

Guest Policy

Members in good standing may request single-day guest passes for non-member guests who are at least 18 years of age, subject to availability and the Spa's approval. Each membership includes one complimentary guest pass per calendar month; additional passes may be issued at the Spa's discretion for a per-pass charge, up to two passes per day. Guests must be accompanied by the member, are subject to the same terms and Rules & Regulations, and may be denied access at the Spa's discretion.

Membership Benefits

Membership benefits vary by tier and may include a monthly single-use spa treatment credit (valid Sunday through Thursday and non-cumulative), pool access for the member plus one guest, fitness center access, and a Marriott Bonvoy points bonus for members who enroll within their first 30 days. Benefits apply only to the member, cannot be combined with other discounts, and are subject to availability, blackout dates, and the Spa's discretion. Taxes and service charges are not included, and pricing may vary on Fridays, Saturdays, and holidays.

Assumption of Risk & Release of Liability

Use of the Spa's facilities, equipment, and services, including the fitness center, pool, sauna, steam room, and treatments, involves inherent risks and may result in physical injury. You voluntarily assume all such risks and use the facilities at your own risk, and you represent that you are in good physical condition to do so. As a condition of membership, you and your guests agree to the Waiver & Release in the Membership Agreement, releasing and holding harmless the Spa, the Hotel, Owner, Operator, Marriott International, Inc., and the other Premises Parties from claims arising from use of the facilities, to the fullest extent permitted by law. Neither Owner nor Operator is responsible for loss of or damage to personal property on the premises.

Intellectual Property

The AWAY and W marks, this website, and its content are the property of their respective owners and may not be used, reproduced, or distributed without permission.

Changes to These Terms

The Spa may amend these terms and the Rules & Regulations from time to time, in its discretion. Material changes affecting members will be communicated as required by the Membership Agreement, and your continued membership constitutes acceptance of the current terms.

Governing Law

These terms and your membership are governed by the laws of the State of Texas, and the exclusive venue for any related actions is Dallas County, Texas. The Membership Agreement includes additional provisions regarding dispute resolution, including arbitration on an individual basis and waivers of jury trial and class actions. This page is a summary only; the signed Membership Agreement is the full and controlling agreement between you and the Owner.
